Application for Redevelopment Waiver

The City of Baltimore Department of Public Works is accepting public review and comments on this project’s application for a redevelopment waiver. If granted, the project will still need to provide water qualitative controls, per the requirements of the State’s Design Manual.

Project Description: The project has an approximate area of 0.979 acres and is located on the south side of Moravia Park Drive between Moravia Road and Frankford Avenue. The project will consist of 3 stormwater management (SWM) facilities: 2 microbioretention areas, 1 large bioretention area, and provide impervious removal.

The Applicant is requesting a redevelopment waiver in accordance with Article 7, §23-7 of the City Code.  The existing impervious area coverage meets the conditions for this waiver.  The project will provide water quality controls as well as impervious area reduction to satisfy the requirements of this waiver for 0.979 acres of this project.

Why am I getting this notice?

We want to tell you that the person or company listed on the notice as the Applicant is asking for a waiver from certain stormwater rules on a construction project in the City of Baltimore. The property where the construction is taking place touches your property, and the City of Baltimore requires that you be notified about this application.

What is a redevelopment waiver?​

When construction projects change the land (for example, from dirt to concrete, or from gravel to pavement), the builders need to provide a plan to manage the new stormwater runoff. In this case, though, the project is on a site that is already developed.   So the builder is asking to avoid having to provide new stormwater management for the entire site.

Is that legal?

Yes. But the Department of Public Works will still make sure the new construction does not increase the stormwater to the neighbors.

Does this have anything to do with the Maryland Stormwater Fee?

No. The fee that property owners have to pay is different from the stormwater management rules that builders have to follow.

How will it affect me?

The waiver application will not affect you.

No. All fees associated with this waiver will be paid by the person or company applying for the waiver.
