The City of Baltimore Department of Public Works is accepting public review and comments on this project’s application for a qualitative waiver. If granted, the project will still need to provide water qualitative controls, per the requirements of the State’s Design Manual.

Project Description: The project has an approximate area of 1.165 acres and is located approximately 200’ east of Falls Road in the Hoes Heights Neighborhood. The project consists of new development for construction of town homes, access road, and utility infrastructure for a residential development.
The Applicant is requesting a qualitative waiver for a fee-in-lieu in accordance with Article 7, §23-2 of the City Code. The project meets the following conditions for this waiver. 1) the project will return the disturbed area to a predevelopment runoff condition, 2) the project is one where environmental site design has been implemented to the maximum extent practicable and it has been demonstrated that other best management practices are not feasible. If this waiver is granted, the project will still be subjected to new development requirements for stormwater management. Among these requirements, the project will be required to provide water quality treatment for 100% of the proposed impervious area (0.597 acres). Currently the project is treating 0.549 acres with Best Management Practices. The project exhibits a hardship in treating the remaining impervious area due to presence of proposed driveway and sidewalk runoff, which is located at the low end of the site near the public right of way. This request would allow the developer to offset the additional impervious area (2100 SF) at a rate of $100,000 per acre of impervious. The fee-in-lieu amount, should this waiver be granted, would be $4,820.94.
