Project Description:

The project has an approximate area of 0.13 acres and is located 100 ft west of the intersection of Linkwood Rd. and Ridgemede Rd., and 200 feet south of the intersection of Linkwood Rd. and Stoneyford Rd. The project will consist of two tasks at two locations. Task one consist of removal of an existing pedestrian bridge and replacement with a new pre-fabricated pedestrian bridge, approx. 45-ft in length, and associated foundations. The new bridge will be located in the same general location as the existing bridge. Task two consist of installation of a new pre-fabricated pedestrian bridge and associated foundations to span Stony Run in the vicinity of the University Parkway Bridge. Approximate length of bridge is 150-ft.

The Applicant is requesting a qualitative control waiver in accordance with Article 7, Division II, §23-2 of the City Code. The Applicant has demonstrated that the project will return the disturbed area to a predevelopment runoff condition. The applicant will not be required to provide qualitative control controls for this project.

The Applicant has demonstrated that on-site water quality control is not practicable. The Applicant will satisfy the water quality controls for this project by payment of fee-in-lieu of on-site stormwater management for this project.

Why am I getting this notice?

We want to tell you that the person or company listed on the notice as the Applicant is asking for a waiver from certain stormwater rules on a construction project in the City of Baltimore. The property where the construction is taking place touches your property, and the City of Baltimore requires that you be notified about this application.

What is a quantitative control waiver?

When construction projects change the land (for example, from dirt to concrete, or from gravel to pavement), the applicant need to provide a plan to manage the new stormwater runoff. In this case, though, the applicant has demonstrated that stormwater cannot be managed using environmental site design methods and runoff goes to the street. So the applicant is not requiring to provide qualitative or quantitative controls.

Is that legal?

Yes. But the Department of Public Works will still make sure the new construction does not change the land.

Does this have anything to do with the Maryland Stormwater Fee?

No. The fee that property owners have to pay is different from the stormwater management rules that builders have to follow.

How will it affect me?

The waiver application will not affect you.

Will it cost me anything?

No. All fees associated with this waiver will be paid by the person or company applying for the waiver.
