Application for Variance, Quantitative Control Waiver, and Qualitative Control Waiver from strict adherence to Stormwater Management requirements

The City of Baltimore Department of Public Works is accepting public review and comments on this project’s application for a variance and qualitative control and quantitative control waivers.

Project Description: The project has an approximate area of 0.52 acres and is located East at the intersection of Potage Ave and E 43rd St. The project will consist of new parking lot and stormwater management in place of structures that were demolished previously.

The Applicant is requesting a variance in accordance with Article 7, Division II, §23-4 of the City Code from providing groundwater recharge for 0.25 acre of impervious surface. The lack of infiltration capacity of the existing on-site soils is the justification for the variance.

The Applicant is requesting a Qualitative Control Waiver in accordance with Article 7, Division II, §23-2 of the City Code. The Applicant has demonstrated that on-site water quality control is provided to the maximum extent practicable. The Applicant will satisfy the water quality controls for this project by providing treatment for 0.35 acre of impervious and Fee-In-Lieu for 0.02 ac of impervious on this project.

The Applicant is requesting a Quantitative Control Waiver in accordance with Article 7, §23-1 of the City Code. The Applicant will satisfy the quantitative controls requirements for this project by providing on-site quantity control to the extent practicable, demonstrating adequate capacity through gutter spread and storm drain analyses, and paying a Fee-In-Lieu for the balance of the requirements for this project.
